{"id":51,"date":"2023-09-02T03:22:37","date_gmt":"2023-09-02T01:22:37","guid":{"rendered":"https:\/\/www.mondovisure.it\/en\/?page_id=51"},"modified":"2023-09-02T19:03:34","modified_gmt":"2023-09-02T17:03:34","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/www.mondovisure.it\/en\/terms-and-conditions\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"\n<p><strong>GENERAL TERMS AND CONDITIONS<\/strong><\/p>\n\n\n\n<p>1 \u2013 INTRODUCTION<\/p>\n\n\n\n<p>All the terms and conditions (hereinafter referred to as &#8220;General Conditions&#8221;) govern the sale of services on Mondovisure.it. The services available on Mondovisure.it are provided by Servizi Informativi S.r.l.s., VAT: 03728230834. All contracts concluded between Servizi Informativi S.r.l.s. and the customer will be governed by these General Conditions. The services on Mondovisure are intended for law firms, professional firms, and companies.<\/p>\n\n\n\n<p>2 &#8211; SUBJECT OF THE CONTRACT<\/p>\n\n\n\n<p>The contract relates to the provision to the customer of the services as indicated in the request forms and with the features specified in the relevant descriptions. Each contract entered into with the customer includes the following documents: General terms and conditions, Request form, Service description, and data processing information.<\/p>\n\n\n\n<p>3 \u2013 CONTRACT CONCLUSION<\/p>\n\n\n\n<p>By submitting an order, the Customer accepts the general terms and conditions, the specific conditions contained within the description of the requested service, and gives consent to data processing. The contract between Servizi Informativi S.r.l.s. and the Customer is concluded with the sending of the order confirmation email and the receipt of payment. When bank transfer is used as a payment method, the order is considered complete when the amount paid for the service request is credited.<\/p>\n\n\n\n<p>3.1 Order Cancellation<\/p>\n\n\n\n<p>Although the order has been finalized, Servizi Informativi S.r.l.s. reserves the right to cancel it at any time, giving prior notice to the customer. The order will be canceled when its execution is impossible due to force majeure, or if the customer does not meet the legal requirements for the service request.<\/p>\n\n\n\n<p>4 &#8211; SERVICE DELIVERY<\/p>\n\n\n\n<p>Once the order is confirmed and payment is received, the service will be processed and delivered as quickly as possible. For services that have a delivery time of 60 minutes, orders must be placed from Monday to Friday from 9:00 am to 5:30 pm. Outside of these hours, they will be processed on the next business day. Services with a delivery time of 4 hours must be placed from Monday to Friday by 4:00 pm.<\/p>\n\n\n\n<p>4.1 Urgent Services<\/p>\n\n\n\n<p>During the times mentioned above, some services can be purchased as &#8220;urgent&#8221;. If the urgency is not met, the customer will be refunded the additional fee paid.<\/p>\n\n\n\n<p>4.2 Delivery Times<\/p>\n\n\n\n<p>Although in 90% of cases the times indicated in the service description pages are respected, it should be noted that they are purely indicative. No responsibility can be attributed to Servizi Informativi S.r.l.s. if these times are not met, especially in cases where the delay was caused by events or third parties not directly controlled or managed by Servizi Informativi Srls.<\/p>\n\n\n\n<p>4.3 Additional Documentation<\/p>\n\n\n\n<p>For some types of services, it may be necessary to request additional documentation from the customer for the task&#8217;s completion. No responsibility can be attributed to Servizi Informativi S.r.l.s. for delays or the inability to provide the service due to the customer&#8217;s inaction or delay.<\/p>\n\n\n\n<p>5 \u2013 REGISTRATION<\/p>\n\n\n\n<p>To request a service, you need to register by creating an account and accepting the Terms, General Conditions, and giving consent to data processing. The account is created using a valid email address and a password. It is recommended to use complex passwords consisting of alphanumeric and special characters combined with uppercase and lowercase letters. By default, the system does not allow the creation of weak passwords. The customer is directly responsible for their login credentials, which are for strictly personal use and must not be given to third parties. In case of theft or loss of login credentials, the customer must promptly inform the Mondovisure customer service so that appropriate measures can be taken to secure the data stored in the account. Account creation is only necessary for the first order; for all subsequent orders, the customer can log in using the credentials entered during registration.<\/p>\n\n\n\n<p>5.1 User Panel<\/p>\n\n\n\n<p>After registration, the Customer can access the user panel to view the status of orders and manage their credentials, such as billing address, order history, etc.<\/p>\n\n\n\n<p>5.2 Account Removal and Data Deletion<\/p>\n\n\n\n<p>To remove your account, simply send an email to <a href=\"mailto:info@mondovisure.com\">info@mondovisure.com<\/a>, and generally, within 48 business hours, all data will be removed except for those that the law requires to be kept. The customer will then receive an email confirmation when the account is removed. The registered user has the right of access to their data, the right to portability, the right to rectification, and any other right in line with the provisions of the EU GDPR 2016\/679 and the national legislation on data processing.<\/p>\n\n\n\n<p>6 &#8211; PURCHASE OF SERVICES<\/p>\n\n\n\n<p>Only the services available on the Mondovisure.it website at the time of order placement can be purchased, as described in their respective information sheets. The correct receipt of the order is confirmed by a notification via email, sent to the email address used by the Customer to create the account. The message provides a summary of the order. The customer agrees to verify its accuracy and promptly communicate any errors. All prices on the site are exclusive of VAT and may change at any time without notice. If an incorrect and\/or clearly trivial price is published for any reason, the order will be canceled, even in the event of initial validation.<\/p>\n\n\n\n<p>7 &#8211; PAYMENT METHODS<\/p>\n\n\n\n<p>To ensure greater flexibility, we offer our customers different payment systems.<\/p>\n\n\n\n<p>7.1 PayPal<\/p>\n\n\n\n<p>By choosing PayPal as the payment method, the customer will be automatically directed to the PayPal page, and thus no data will be transferred through Mondovisure.it. PayPal is one of the most widely used online payment systems. Through the PayPal platform, the Customer can make the payment using a PayPal account, a prepaid card, a debit card, or a credit card belonging to networks like Visa, MasterCard, etc.<\/p>\n\n\n\n<p>7.2 Stripe<\/p>\n\n\n\n<p>It is possible to select a credit card as a payment method and pay for the order with a credit card, reloadable card, Poste Pay, etc. In this case, the payment is made directly on the checkout page.<\/p>\n\n\n\n<p>7.3 Advance bank transfer<\/p>\n\n\n\n<p>In case of payment by Advance Bank Transfer, the order processing will begin upon credit confirmation, which must occur within 5 working days from the date of order acceptance, after which the order will be automatically canceled. The bank transfer reason must state the order identification provided in the order confirmation email. The bank details for the transfer are provided in the order confirmation email.<\/p>\n\n\n\n<p>7.4 Credit recharge<\/p>\n\n\n\n<p>Customers can also opt for purchasing a recharge. The credit can be used to purchase any service, even those on offer. The rechargeable card has no expiration date. Depending on the recharge amount, the customer is granted a bonus added to the value of the already purchased credit. The rechargeable card can be managed from the customer panel.<\/p>\n\n\n\n<p>8 &#8211; DELIVERY METHODS<\/p>\n\n\n\n<p>The services purchased on Mondovisure are delivered digitally. If the requested service includes a paper document, it will be shipped via courier or mail, and shipping costs will be specified at the time of order completion and are the responsibility of the customer. Generally, when the order is complete, the customer receives a notification email indicating that the order has been completed. The email also provides a link to download the file directly from their user panel. The completed order notification email also attaches the document in PDF format. It will be available for 15 days in the customer area; after this period, for security reasons, the file is deleted.<\/p>\n\n\n\n<p>9 &#8211; RIGHT OF WITHDRAWAL<\/p>\n\n\n\n<p>In compliance with the Consumer Code, Customers, defined as individuals acting for purposes unrelated to their professional, and\/or business activity, have the right, under art. 52, to withdraw from the purchase contract within 14 days of its conclusion. This can be done by sending a registered letter addressed to Servizi Informativi S.r.l.s., Via Dei Mille 243, 98123 Messina (ME) or a certified email to <a href=\"mailto:servizi.informativi@legalmail.it\">servizi.informativi@legalmail.it<\/a>.<\/p>\n\n\n\n<p>9.1 Exclusion of withdrawal<\/p>\n\n\n\n<p>Withdrawal, according to art. 59 of the consumer code, cannot be validly exercised if the service was performed within the 14-day period.<\/p>\n\n\n\n<p>9.2 Refunds<\/p>\n\n\n\n<p>In the event of a withdrawal, if Servizi Informativi S.r.l.s. has begun providing the service, they must be compensated for all incurred costs. No refunds will be given if the outcome of the requested service research is negative. No refunds will be made if the negative result of the research was caused by incorrect or incomplete data provided by the customer.<\/p>\n\n\n\n<p>9.3 Supplier withdrawal<\/p>\n\n\n\n<p>Servizi Informativi can freely withdraw from the contract with the customer, after a reasonable 15-day notice communicated via certified email or registered letter. However, they may withdraw immediately if the customer engages in illicit behavior against the company or due to force majeure.<\/p>\n\n\n\n<p>10 &#8211; OBLIGATIONS AND RESPONSIBILITIES<\/p>\n\n\n\n<p>Servizi Informativi assumes no responsibility, except in cases of intentional misconduct or gross negligence, for any delays, mistakes, or other damages suffered by the customer or third parties during contract execution.<\/p>\n\n\n\n<p>10.1 Customer obligations<\/p>\n\n\n\n<p>For any non-compliant, unauthorized, or illegal use of the requested services, the customer will be held solely and exclusively responsible. The customer commits to indemnify and hold Servizi Informativi S.r.l.s. harmless from any liability and\/or compensation claims for damages caused to third parties. Data cannot be disclosed or transferred.<\/p>\n\n\n\n<p>10.2 Communication of third-party data<\/p>\n\n\n\n<p>Regarding third-party data communicated to Servizi Informativi S.r.l.s. during the service request and\/or subsequently, the customer declares that they are familiar with European and national data processing regulations and is the Data Controller as: they have obtained consent from the third party, have a legitimate interest in relation to it and\/or another condition provided by the legislator legitimizing data processing ownership. Servizi Informativi S.r.l.s., with respect to the customer and the data provided by them, acts as a mere external data processing manager as required by European and national data processing regulations.<\/p>\n\n\n\n<p>10.3 Asset investigations<\/p>\n\n\n\n<p>Services in the debtor tracking category and all those that involve investigative activity are provided to Servizi Informativi S.r.l.s. by third-party companies authorized under art. 134 T.U.L.P.S.. All information in the respective reports results from investigations, research, and interviews conducted following the standards set by art. 5 of the decree of December 1, 2010, n. 269, and subsequent amendments. The customer indemnifies Servizi Informativi S.r.l.s. and third-party companies from any liability regarding errors and\/or inaccuracies in the requested reports. It is noted that the transmitted data must be processed exclusively for the judicial validity of rights and\/or the protection of company assets, without their dissemination being allowed.<\/p>\n\n\n\n<p>11 &#8211; RESOLUTION<\/p>\n\n\n\n<p>Failure to comply with the obligations set out in these general conditions results in the termination of the contract and the cancellation of all ongoing orders. Specifically, the contract will be terminated immediately if the customer violates the obligations set out in points 10.2 and 10.3. The contract will also be terminated with immediate effect if the information provided during registration or service request is false or if the services requested are used for illegal purposes and\/or in any case prohibited by the current regulations.<\/p>\n\n\n\n<p>12 \u2013 JURISDICTION AND APPLICABLE LAW<\/p>\n\n\n\n<p>The sales contract between the Customer and Servizi Informativi S.r.l.s. is governed by Italian Law.
